Estimates
The estimates stated in the catalogue are in SEK and serve as a guideline for the buyer. The purchase price may be higher or lower than the estimate. The consignor may have set a reserve on the lot. A reserve never exceeds the estimate in the catalogue.

The catalogue
All lots are sold “as is”. The bidder accepts full responsibility to inspect and evaluate the lot to his or her satisfaction prior to the auction. Descriptions in the catalogue are guidelines for the buyer and do not exempt the buyer from his or her responsibility to inspect the lots being sold. Probus is not liable for natural wear or small damages, defects or natural changes in material such as wood, paper or leather. If essential information in the catalogue description is wrong this may be the grounds for revoking a purchase. A claim due to defects must be submitted in connection with the collection of the lot or at the latest 10 days after the auction. Questions concerning the authenticity or maker of the work must be raised within 2 years of the day of the auction.

Responsibility/liability
Probus’s responsibility to the buyer is always limited to a reduction in price or at the most refund of the hammer price plus commission including VAT. Probus is not responsible for direct or indirect damages that the buyer may incur.

Bidding

This hammer auction held online in Stockholm, Sweden begins at 10 am CEST on April 19th.

Pre-sale online bidding for Auction 38 is open until 10.00 am CEST on April 19th. After that, you can bid in real-time (live) online, see below.

Registered customers must log in, under “mina sidor, (my pages ) to bid. Please note that there are preset bid increments. You can also place a maximum bid. The system will bid automatically on your behalf up to your maximum bid.

Absentee bids

Written bids are accepted on the behalf of customers with valid identification. Absentee bids are treated confidentially and customer service will bid on your behalf and will attempt to purchase the indicated lot(s) at the lowest possible price without exceeding the indicated amount. The deadline for Absentee bids, which are faxed or sent by e-mail, is 4 pm (16:00) CEST on April 14th. If we receive more than one bid of the same value, the first one received will take precedence.

Absentee bids, whether written or executed by telephone, is a service for the client, Probus will not be liable for errors, omissions or failures to execute bids. Probus is not liable for any loss that the client may incur if Probus fails to carry out the absentee bids. The buyer is responsible for purchases executed through absentee bidding. The client is held responsible for purchases registered from an illegible or incorrect absentee bid. Probus reserves the right to not accept an unclear or illegible written bid.

Results
It is the responsibility of the absentee bidder to check that his or her bid has led to a successful purchase.

Purchase and Payment

Your invoice will be found on ”mina sidor” after the auction. If you want Probus to arrange shipping, a new invoice will be issued on “mina sidor” once the shipping costs have been determined.

The purchase price to the buyer for the lot is the amount of the successful bid price and the buyer’s premium of 22,5%
Payment is made by bank transfer, all transfers must state the relevant lot or invoice number and buyer’s Client number. Payment must be made at the latest 14 days after the auction. Probus reserve the right to charge a late payment fee of 2% per month on the purchase price if payment is not received on time.

Collection of purchased lots
No purchase may be claimed or removed until it has been fully paid for unless otherwise agreed to by Probus. Lots may be collected at Grevgatan 6 by appointment only. For shipping please contact Probus.

Force majeure
Probus is exempt from sanction for failure to meet a certain obligation in accordance with this agreement if the failure is based on a circumstance of the type stated below and the circumstance prevents or considerably hinders, the obligation being met promptly. Circumstances providing grounds for exemption include the act of war, currency restrictions, shortage of transport, fire, measures taken by an authority, change in legislation, industrial conflict, general shortage of goods, restrictions on fuel, accidents or equivalent circumstances. If Probus meeting of a certain obligation is delayed more than three months owing to a circumstance providing grounds for exemption, the purchaser is entitled, without having to pay compensation, to cancel the purchase in writing.

Disputes
Disputes concerning these terms shall be settled in accordance with Swedish law at a court in Sweden.
